Time to File Phoenix Hail Damage Claim May be Quickly Running Out

On October 5, 2010, the Phoenix area was pelted with hail the size of golf balls and larger - with some metropolitan areas reporting ice chunks as large as baseballs. Tens of thousands of businesses and homes were bombarded, with estimated damages totaling nearly $2 billion. The damage was so severe and extensive that waiting lists were as long as four months just to get a damage appraisal from roofing contractors.
The one year anniversary of this devastating Phoenix hailstorm is also notable for one very important reason: Arizona policyholders may be running out of time to bring a claim against their insurance company.
Large storms inevitably lead to disputes with insurance companies, and even though the statute of limitations in Arizona for contract disputes is generally six years, a code provision in Arizona expressly permits an insurance company to limit the time for a policyholder to bring suits against insurers to a much shorter period.
Specifically, the law states that the time to file a suit for property loss may be limited as long as "such time shall not be limited to less than one year from the date of occurrence of the event resulting in the loss."
Because of this law, insurance companies in Arizona are able to shorten the normal limitations period of six years in properly loss disputes, as long as the limitation stated in the policy is no less than one year.
It is vital for policyholder to review their policies immediately to see if their insurance company has inserted a one year limitation as this deadline is quickly approaching.
